on Apr 16, 2026 After reinstalling code-server using brew, it returned to normal. However, Homebrew is no longer willing to continue supporting versions 4.113.0 and later. What's going on?
==> code-server ✔: stable 4.112.0 (bottled) Access VS Code through the browser https://github.com/coder/code-server Deprecated because it uses non-FOSS @github/copilot since 4.113.0! It will be disabled on 2027-04-11.Does the fact that it's deprecated because it uses non-FOSS mean that future versions of code-server can no longer be installed via brew?
Huh yeah I guess this is because VS Code started bundling the copilot sdk which does appear to be non-foss.

code-server v4.116.0 has GitHub Copilot built-in, which allows using AI Features without having to install the GitHub Copilot extension1. According to #7754 (comment), the installation pulls in the Copilot SDK.
@code-asher If this [SDK] is non-FOSS, is it then permitted to bundle it with code-server – which is under the MIT license?
Footnotes
-
The standalone extension was non-FOSS and – according to the license terms – only permitted for use with Microsoft Visual Studio Code ↩
-
If this is not permitted, the integration of GitHub Copilot into code-server must be prevented in some way.
I am not sure if the dependencies have to be FOSS for the repo license to be MIT, but I am not a lawyer. 🤔
Although if the license terms say it can only be used in Microsoft builds then it does seem like we would have to strip it out. I was looking at the sdk license but was not seeing anything like that https://github.com/github/copilot-cli/blob/main/LICENSE.md
I think the old copilot vsix maybe have been licensed this way, but the new built-in extension code seems to be MIT https://github.com/microsoft/vscode/blob/main/extensions/copilot/LICENSE.txt
Maybe we could provide a way to build code-server without copilot for Homebrow or something like that.
Reacted by Olivier Benz and yinyu985Regarding the license terms: IMHO no issue for code-server here. Homebrew reverted to v4.112.0 because
This is considered non-FOSS and unacceptable in Homebrew/core as it does not meet https://docs.brew.sh/License-Guidelines

Reacted by Asher@ysysimon Could you please update the title of this issue?
The focus shifted from "brew missing the vscode.git extension's module" to "brew no longer willing to continue supporting versions 4.113.0 and later"
Thank you.

on May 12, 2026 Oh yup you are right:
The use with Code-OSS is allowed for development purposes only. No other use is permitted.
Looks like we will have to remove the Copilot extension to comply with the license.
It is strange how the build command includes Copilot though, so by default if you just clone the repo, build, then distribute without doing anything else then you violate the license without even realizing it.
I checked Arch Linux's open source build for example and it also includes the Copilot extension (along with the above mentioned license)
Is there an existing issue for this?
